HOA President Is “Tired of Seeing American Flags,” So She’s Doing THIS

The President of the Chestnut Place Condominium HOA in Murray, Utah, Lyn Steinbergen, claimed she was “tired of seeing flags” flying up and down the street all day and all night, 365 days a year. She decided the flag is only for holidays and fined a condo owner $75.00 for refusing to take it down.

The flag only for holidays?

“Flags are flown on holiday events. All we are trying to do is regulate when the flag goes up, and when it comes down.” Lyn Steinbergen, President of the HOA.

Steinbergen recently resigned from her position on the HOA.

The residents of the condo have been flying their American flags all the time. One resident who refused to take it down was fined $75.00 under a homeowners clause for “decorations.” They were told to immediately take the flags down.

Worthen, one of the residents who was fined, is furious. She has two relatives who were U.S. Navy veterans. Her flag is about honoring their service.

“The men and woman who serve our country do a job that I could not do…. People have died for that… We have a right to fly our flags.” Erin Worthen

The Homeowner’s Board canceled a meeting at the last minute – possibly because they learned that residents wanted to vote them off the board. The residents of the condo community are reportedly considering nominating Erin to be the next president. They are waiting for the next board meeting to see what the outcome will be.

Newsflash: The American Flag is not a decoration!

Ms. Worthen is correct – people have died for that flag. It is not and was never meant to be a “decoration.”

From 1776 to today, Americans have fought and died for the symbol of our nation’s strength and unity. It has been a source of pride and inspiration for over 200 years.  It is the symbol of patriotism for America. Reducing it to a “decoration” is infuriating.

In this case, there is more than one person flying the flag. The HOA considers roofs a ‘common area’ not owned by the condo owner, and the walls are also considered a ‘common area.’ It’s the “common areas” that are in question.

    An Act

    To ensure that the right of an individual to display the flag of the United States on residential property not be abridged.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

    SECTION 1. SHORT TITLE.

    This Act may be cited as the `Freedom to Display the American Flag Act of 2005′.

    SEC. 2. DEFINITIONS.

    For purposes of this Act–

    (1) the term `flag of the United States’ has the meaning given the term `flag, standard, colors, or ensign’ under section 3 of title 4, United States Code;

    (2) the terms `condominium association’ and `cooperative association’ have the meanings given such terms under section 604 of Public Law 96-399 (15 U.S.C. 3603);

    (3) the term `residential real estate management association’ has the meaning given such term under section 528 of the Internal Revenue Code of 1986 (26 U.S.C. 528); and

    (4) the term `member’–

    (A) as used with respect to a condominium association, means an owner of a condominium unit (as defined under section 604 of Public Law 96-399 (15 U.S.C. 3603)) within such association;

    (B) as used with respect to a cooperative association, means a cooperative unit owner (as defined under section 604 of Public Law 96-399 (15 U.S.C. 3603)) within such association; and

    (C) as used with respect to a residential real estate management association, means an owner of a residential property within a subdivision, development, or similar area subject to any policy or restriction adopted by such association.

    SEC. 3. RIGHT TO DISPLAY THE FLAG OF THE UNITED STATES.

    A condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use.

    Most of these HOA’s are run by a bunch of gestapo wannabes. Don’t get me wrong, I do believe that some rules make sense and are needed. But for the most part you get people that get a little bit of power and they loose all common sense.

    UNITED STATES CODE, TITLE 36, CHAPTER 10, Para 174 (d) states, “The flag should be displayed on ALL DAYS, especially on …” then it lists certain holidays. It does say it should be displayed on ALL DAYS. The housing association president is mistaken.

    No one deserves to be told that cannot fly the AMERICAN FLAG IN AMERICA! No one should have to watch someone burn OUR AMERICAN FLAG, IN AMERICA! No one should have to watch people IN AMERICA, DESECRATE OUR AMERICAN FLAG! It should be a felony or an act of treason, if one or more persons were to do this! I don’t want to hear any freedom of speech, 1st Amendment crap. What do you think those Men were carrying on the battlefield in Lexington? Many brave Men and Women have died while serving in a Militia or our Military while either carrying OUR AMERICAN FLAG, or donning it on their uniforms! This also applies to the Men and Women who sacrificed their lives in the Military to be prepared, train, and fight at the ready. It also applies to our Law Enforcement, Firefighters, First Responders! God Bless America! I’m glad that hag resigned. She should be put in jail!

    Under the federal Freedom to Display the American Flag Act of 2005, no condo, co-op, or homeowner association can restrict its owners from displaying the U.S. flag on their property.

    I am constantly amazed how these incompetents are elected to a HOA board and are convinced that they have unlimited power!! This person needs to get a different hobby or a job and stay off her HOA flags. The community needs her gone. I am part of a HOA and we fly our flags day and night. We even install lights to meet the flag flying rules. I would immediately start a recall petition against this fool.

    It is scary how much anti-americanism is going on right now, thanks to the obama and the liberals. So this hateful hag can dictate what is on ‘common areas’….so why doesn’t every single homeowner there take down the curtains and blinds in their biggest front window, and cover it with an American flag? It would be INSIDE the house and the hag couldn’t touch it but everyone would see it.

    If Mrs Steinbergen doesn’t like the American flag, then she is perfectly free to either shut her eyes, or just go to some other country where she DOES like their flag. There are 191 other countries she can try. I suggest she try Iran first.

    Co-incidentaly or not, Steinbergen is a Jew. Most Jews it seems have their loyalty towards some other country and have an-American agenda. They are the ones behind banning the ‘pledge of allegiance’ in public schools. They are the ones who require a stupid menorah to be put wherever a XMas tree is put.       I have no problems with Jewish wishes to have their holidays and religion recognized, they are tolerant of my religion. I do have a problem when a symbol of our nation is relegated to holidays. The cry for tolerance (of gays, minorities, muslims, etc) should not negate the tolerance for patriotism, christianity, and freedom.

      It’s funny you should say this. I served in the Navy for 20 years. Vietnam thru Desert Storm. I served with many Jews. Some were cool, some patriotic, some just want to do their hitch, get out and go to school on their G.I. Bill. In other words, Jews are like everyone else. I share a deep brotherhood with my Jewish brothers and Sisters. They fought hard, they fought gallantly. God bless each and every Jew and God save Israel from Nazi Terrorists, such as yourself. By-the-way, I’m Polish/Catholic descent. Do you want to come after me now? Come and get it, Punk.

  18. Since Ms. Steinbergen is tired of the US flag, she needs to find another country to go to. Our flag represents all those who have bravely fought and died for our freedoms, as a proud Air Force vet, I dare anyone to tell me I’m not allowed to fly it.
